Higher Calling Auctions Terms and Conditions for Real Estate Auctions

The property is offered under specific terms and conditions. Please read thoroughly before bidding. If you have not reviewed these terms, do not bid.
1. Registration
This auction is online only. By registering, bidders acknowledge they have read and agree to these terms and conditions. Registration confirms understanding of these terms and agreement to be bound by them.
2. Auction End Times
Higher Calling Auctions online auctions are timed events. Auctions include an auto-extend feature: any bid placed in the final 10 minutes extends the countdown by 5 minutes. The auction continues to extend until no further bids are received in the extended time frame.
3. Buyer’s Premium
A buyer’s premium of 3% will be added to the final bid price to determine the contract price.
Example: High bid: $100,000 + 3% Buyer’s Premium = Contract Price: $103,000.
4. Non-Refundable Down Payment
A non-refundable earnest money deposit of $5000 of the purchase price is due within 48 hours of the seller acceptance. The deposit must be in the form of a business check, certified check, or wire transfer, submitted by the end of the business day of the auction. We do not accept a credit card for down payment. The remaining balance is due within 30 days or upon closing. The buyer shall be responsible for any wire transfer fees, if applicable.
5. Auction Contract
The successful bidder shall execute the auction contract within 48 hours following the close of the auction. Failure to submit the deposit or execute the contract will result in a penalty of $4000.00 charged to the bidder’s credit card on file. Additional remedies are reserved by Higher Calling Auctions and the seller.
6. As Is, Sale
All property is sold "As Is, " with no warranty expressed or implied by Higher Calling Auctions or the seller. Bidders are encouraged to conduct personal inspections and appraisals, obtain financing at their own expense prior to bidding. No concessions will be made, so bid accordingly.
7. Taxes
Real estate taxes and assessments will be prorated to the day of closing.
8. Closing
Buyer and seller will share customary closing costs. Closing must occur within 30 days of the auction date. Closing agent/location will be determined in accordance with contract for purchase.
9. Possession
The purchaser shall receive possession of the property at closing.
10. Evidence of Title
The seller will furnish an Owner’s Policy of Title Insurance at their expense and convey the property with a warranty deed free of encumbrances.
11. Survey
No boundary survey will be provided as part of this auction. Land measurements in this packet are approximate based on County Assessor’s information. Aerial photos are for illustration purposes only and not surveyed boundary lines.
12. Broker Participation
A commission will be paid to any properly licensed Broker who registers a successful buyer according to the Broker Participation Agreement. This form is available from the Auction Company and must be completed and returned 48 hours prior to the auction.

Higher Calling Auctions acts as an agent of the seller, with fiduciary duties owed to the seller.
16. Bidder Verification
The identity of all bidders will be verified. Bidding rights are provisional and may be revoked if verification is incomplete.
17. Liquidated Damages
If the buyer fails to close within the specified time and no written extension has been granted, the earnest money deposit will be forfeited as liquidated damages.
