TERMS AND CONDITIONS OF SALE
GENERAL TERMS
1. AGREEMENT TO TERMS By registering to bid, whether in person, by telephone, absentee bid, or through our online platform, all bidders agree to be bound by these Terms and Conditions of Sale. These terms constitute the entire agreement between Burgess Auctions and the bidder.
2. AUCTIONEER AUTHORITY The auctioneer has absolute discretion to:
- Reject any bid
- Advance bidding at his/her discretion
- Withdraw any lot from sale
- Resolve any disputes regarding bidding
- Take any other action deemed necessary for the proper conduct of the sale
3. BIDDER REGISTRATION All bidders must register prior to the sale and provide:
- Valid government-issued photo identification
- Completed bidder registration form
- Credit card information for verification purposes (online bidders)
- Any additional documentation as required by the auctioneer
BIDDING PROCEDURES
4. LIVE BIDDING
- The majority of lots will be sold through live, onsite bidding
- Bidding increments are at the auctioneer's discretion
- The highest acknowledged bid will be the successful bid
- In case of dispute, the auctioneer's decision is final
5. SIMULCAST BIDDING (SELECTED ITEMS)
- Selected lots will be available for online bidding through our approved platform
- Online bidders compete equally with floor bidders
- Technical difficulties with online platforms do not constitute grounds for cancellation of sale
- Burgess Auctions is not responsible for failed internet connections, technical malfunctions, or missed bids due to platform issues
- Online bidders should monitor their connection and bid early if experiencing technical difficulties
6. ABSENTEE BIDS
- Written absentee bids will be accepted until one hour prior to sale start
- Absentee bids will be executed at the lowest possible winning amount
- Burgess Auctions will make every effort to execute absentee bids but assumes no responsibility for failure to execute such bids
7. TELEPHONE BIDDING
- Available by prior arrangement for lots with estimates of $500 or higher
- Must be arranged at least 24 hours prior to sale
- Limited number of phone lines available
- Burgess Auctions assumes no responsibility for missed calls or technical difficulties
PAYMENT AND COLLECTION
8. BUYER'S PREMIUM A buyer's premium of 15% will be added to the hammer price of all lots. This premium is subject to applicable sales tax.
9. SALES TAX: This is a taxable event.
10. PAYMENT TERMS
- Payment is due in full on sale day
- Accepted forms of payment: Cash, cashier's check, money order, approved personal check (with proper ID), or credit card
- Personal checks over $1,000 require bank verification
- Credit card payments may be subject to processing fees
11. COLLECTION OF PURCHASES
- All items must be paid for and removed by Friday October 31 5:00PM
- Buyers are responsible for bringing adequate help and equipment for removal
- Items not removed by the deadline will incur storage fees of $5 per lot per day
CONDITION AND INSPECTION
12. CONDITION OF LOTS
- ALL SALES ARE FINAL
- All lots are sold "AS IS, WHERE IS" with no warranties or guarantees
- Descriptions are provided as a service to bidders but are not guaranteed to be accurate or complete
- Age, condition, authenticity, attribution, and provenance are matters of opinion
13. PREVIEW AND INSPECTION
- Public preview will be held on Wednesday August 27 8:00AM
- Bidders are strongly encouraged to personally inspect all lots of interest
- Condition reports may be available for selected lots upon request
- Failure to inspect lots prior to bidding does not constitute grounds for return or refund
DEFAULT AND REMEDIES
14. DEFAULT BY PURCHASER If a successful bidder fails to pay for purchases:
- The lot(s) may be re-offered for sale
- The bidder will be liable for any deficiency plus costs
- The bidder may be prohibited from future sales
- Legal action may be pursued for collection
15. DISPUTES
- All disputes must be brought to the auctioneer's attention on sale day
- No claims will be considered after items are removed from the premises
- The auctioneer's records will be conclusive evidence of sale details
ADDITIONAL TERMS
16. ANNOUNCEMENTS Any announcements made on sale day supersede all previous advertising and printed materials.
17. PHOTOGRAPHY AND RECORDING Burgess Auctions reserves the right to photograph or record the sale for security and promotional purposes.
18. LIMITATION OF LIABILITY Burgess Auctions' liability is limited to the purchase price of any lot. We are not responsible for personal injury, property damage, or consequential damages.
19. JURISDICTION These terms shall be governed by Indiana law. Any legal proceedings shall be conducted in the appropriate courts of Henry County, Indiana.
20. SEVERABILITY If any provision of these terms is deemed invalid, the remaining provisions shall remain in full force and effect.

Burgess Auctions LLC is pleased to offer in-house packing and shipping services on most auction lots. We handle the entire process from careful packing to coordinating delivery — so your items arrive safely and securely.
We take great pride in how we pack and protect every item entrusted to us. From fragile antiquities to sterling silver and fine art, each package is prepared with the same care we bring to every auction.
How Our Shipping Process Works
1 Pay Your Auction Invoice First
Before we begin packing your items, your auction invoice must be paid in full. We cannot begin the packing and shipping process until payment has been received and cleared.
2 Email Us to Request Shipping
Once your auction invoice is paid, email us at [email protected] to let us know you need shipping. Include your name, invoice number, and which lots require shipping.
3 We Pack Your Items In-House
Our team carefully packs your items in-house with appropriate materials for each lot type. Fragile, antique, and high-value items receive special attention and protective packaging. Please allow up to 7–10 business days for us to get your items packed and ready to ship.
4 You Receive a Shipping Invoice via Shipping Saint
Once your items are packed and a shipping quote is confirmed, we will send you a separate shipping invoice through Shipping Saint. This invoice will detail the carrier, shipping cost, insurance, and any applicable handling fees.
5 Pay Your Shipping Invoice
Pay your Shipping Saint invoice promptly. Your package will not leave our facility until the shipping invoice has been paid in full.
6 We Ship Your Package
Once your shipping payment is received, we ship your package and provide tracking information so you can follow your items all the way to your door.

After auction day, our team works carefully through each lot to ensure proper packing for every item. High-value, fragile, and unusual items take additional time to pack safely. We appreciate your patience — we would rather take the time to do it right than rush and risk damage to your purchase.

In-House Packing
All items are packed by our team at our Knightstown facility. We do not outsource packing to third parties. This means every item is handled by people who know the catalog, understand the fragility of each lot, and take personal responsibility for its safe arrival.
Packing materials are selected based on the specific needs of each item:
• Fragile antiquities and fine art receive foam padding, bubble wrap, and rigid outer packaging
• Sterling silver and metalwork are individually wrapped and cushioned to prevent surface damage
• Multiple lots shipped together are carefully separated and secured within the same package
• Unusually large, heavy, or fragile items may require custom crating — we will advise you if this applies to your lot
Shipping Invoicing via Shipping Saint
Burgess Auctions uses Shipping Saint to manage all shipping invoices. When your items are packed and ready, you will receive an email from Shipping Saint with your shipping invoice. This is a separate invoice from your auction purchase invoice.
Your Shipping Invoice Will Include:
• Carrier selection and shipping method
• Shipping cost based on package dimensions and weight
• Insurance on the package
• Any applicable handling fees
• Tracking information provided upon shipment
Important: Your package will not ship until both your auction invoice AND your Shipping Saint shipping invoice have been paid in full. We cannot release items for shipping until all balances are cleared.
What We Can & Cannot Ship
We ship the majority of lots from our auctions. However, some items may not be eligible for shipping due to size, weight, fragility, or legal restrictions. Items not eligible for shipping must be picked up in person.

Damage, Loss & Insurance
All packages are insured through our shipping carrier at the declared value of the item. In the event of damage or loss during transit, claims must be filed promptly through the carrier. Burgess Auctions will assist you in the claims process where possible.
• Report any damage immediately upon receipt — photograph the packaging and item before disturbing anything
• Do not discard original packaging materials until the claim is resolved
• Burgess Auctions is not liable for carrier delays, weather-related delays, or events outside our control
• Once a package leaves our facility with a confirmed carrier scan, responsibility transfers to the carrier
